Once I send you the email and we agree on the price and commission details, I'll send you a contract that I need you to sign and send me back befor I can send an invoice via PayPal . I begin drawing as soon as I receive the payment and after completing any commissions in my queue. [You can see the list at the bottom.] Finishing a commission usually takes me between 5 days and two weeks, depending on the complexity.I. Scope of Work:Work will be delivered in a digital format of no less than 300 DPI and created in the size best suited for the Client’s intended distribution. If necessary, the artist will adjust the file size and format (JPG, PDF, etc.) at the client's request, this service is provided once [although adaptable to multiple formats]. Such request can be made within one week of the illustration work's completion, although it is preferable to be notified in advance so that the necessary adjustments can be made in the file.Due Date. The start of the Work would be once Artist get this contract signed and the first [or total] payment, notifying the author via email of the exact day they are starting. Finished art shall be delivered before deadline discused. In order for the final art due date to be met, revisions must be approved in a reasonable amount of time (within 2 working days). If they’re not, a new final art due date must be negotiated or an additional rush fee will be added.No physical items will be shipped to the Client.II. ProcessThumbnail Phase: Client receives 1-3 initial lineart thumbnails as watermarked, low-res JPGs. Client has the opportunity to approve the composition or select their favorite one if receiving more than one sketch, and request changes. Client may request two (2) rounds of revisions at this phase, such as changes of layout/composition, shape/size of the subjects, and their placement, etc.Sketch Phase: Client receives 1 detailed sketch as watermarked low-res JPEGs.
Client has the opportunity to approve the composition or select their favorite one if receiving more than one sketch, and request changes. Client may request one (1) round of revisions at this phase, such as small changes in the pose, etc…
Flats Phase: Watermarked low-res JPEGs of the Lineart and Flats will be sent to the client for approval; client may request one (1) round of revisions, such as color changes, and edit of small details (expression, accessories...)Final Art Phase: Watermarked low-res JPGs of the Final Art will be sent to the client for approval. Client may request one (1) round of revisions. Any changes made here will be minor edits only (mostly color fixing). Upon receipt of complete payment, Artist sends Client the completed illustration.III. Artist’s Personal & Commercial Use of the Work:Upon receipt of full payment, the Artist grants to the Client the following rights in the finished art:— For commercial if it's required [+100% fee added]
This include:
Any means that generates income for the Client: Patreon, streams, merchandise for sale, etc.
— Promotional use (marketing & advertising) Included in original price no fees added.
This include:
• Put the art on their website
• Post it on social media, including in posts advertising their books.
• Use it in their newsletter and in ads for their books.
• Print it on bookmarks and similar items for the Client to give away for free at events or with orders.
It can also be used for any promotional purpose not expressly included above, provided that it does not involve on direct sales outside of those previously agreed upon the comercial use.The Artist retains the right to use the Work in connection to their portfolio and personal biography, provided such use may not be made public until after the initial release of the Work or within 1 (one) year after creation should the Client decide not to use the Work commercially. Under this Agreement, the Artist may additionally permit third parties to reproduce the Work in books that profile the Artist provided that any such book does not feature the Work on the cover or in advertisements. Artist agrees to ensure any use of the Work in this fashion will be accompanied with credit to the Client as holder of the Intellectual Property to which this Work was created for.This agreement does not grant the Client the right to provide the Artist's Work as a basis for any other artist to recreate, derive from, or expand upon in any manner without expressed written consent from the Artist, this restriction applies to the Work itself. It does not restrict the Client from commissioning other artists to create new and independent depictions of the Client's Intellectual Property.IV. Intellectual Property: The Client owns and/or has the rights to use the imagery, names, derivatives, and/or associated works with this Intellectual Property (“IP”) and takes sole responsibility for any liability, suit, claims, and/or deformation should it be established to the contrary. It is the Clients sole responsibility to procure any necessary rights, fees, and/or permissions to use any materials provided to create the Work. The Client understands that the Work is under their IP copyright and agrees that it is their sole responsibility to protect said IP at their own expense. The Client further agrees to not hold the Artist liable for any infringement of IP and will not hold them accountable, responsible, nor liable for theft, derivative work, or fan art that may incur due to public display of the Work.V. Fees & Payment:
Payments can be made via PayPal (a fee will be added to the base price), Bizum, bank transfer, or another method agreed upon by both parties.
Payment can be made full upfront, or split 50% at the start and 50% upon completion; the work will not be delivered until the final payment is made, and this split-payment method will incur double PayPal fees.Revisions:
The Artist shall be given the first opportunity to make any revisions requested by the Client. If the revisions are not due to any fault on the part of the Artist, an additional fee shall be charged. If the Artist objects to any revisions to be made by the Client, the Artist shall have the right to have her name removed from the published Work.
Once the Client has arranged and sent payment, the Artist commits to delivering the full Work.VI. Release of Liability: Client agrees that it shall not hold Artist or any agent thereof liable for any damages arising from Artist’s failure to complete the Work in a timely manner, regardless of whether such failure was caused by intentional or negligent acts or omissions of Artist or of any third party.VII. Courtesy Copies: In the event that the Work is used in a physical product first published by the Client, the Client will send the Artist, at the Client's expense, one (1) courtesy copy of one such product, on the Artist's request. Where international shipping is impractical or a digital equivalent exists, the parties may agree to a digital copy in place of a physical one.VIII. Credit: To the extent commercially reasonable and practical, the Client will identify the Artist as the creator of the Work on products and publications that incorporate or utilize the Work. Credit will specifically name the creator as the Artist’s name, “Lemoncielart” with a link to the Artist’s website, lemoncielart.carrd.coIX. Artificial Intelligence: By commissionen the Artist, the Client confirms and assures that Artificial Intelligence (AI) is not used to create any aspect of the product where the Work is included since it can also damage the artist's reputation. Should it be discovered that the Client used AI in any portion of a graphic or illustration with that work in it, they agree to remove the Artist’s Work from the product without requesting nor expecting any portion of the fees paid being refunded.The Artist also confirms that AI was not used in any portion for any part of the process of creating nor completing the finished art. They also confirm that AI was not used as a reference, a base, to manipulate, alter, nor finish the project.X. Cancellation:The Client or the Artist may cancel this agreement at any time by providing written notice to the other party. If either Client or the Artist cancels a project before any payment has been made, neither the client nor the Artist is under further obligation to the other, and this contract will be considered cancelled.If the Artist fails to complete the work for reasons within their control, they are required to issue a full refund to the Client; however, if the Client decides not to proceed with the work after it has begun, past the Thumbnail Phase they are entitled to a refund of only 50%.I have a Ko-fi account if you'd like to add a tip to the commission price: ko-fi.com/makartWhat do I ask when you work with me?— Patience. Mi método de trabajo

La Obra se entregará en formato digital con una resolución mínima de 300 DPI y se creará en el tamaño más adecuado para el uso o distribución previstos por el cliente. Si fuera necesario, el artista ajustará el tamaño y el formato del archivo (JPG, PDF, etc.) a petición del cliente; este servicio se ofrece una vez [aunque es adaptable a múltiples formatos]. Dicha solicitud puede realizarse en el plazo de una semana tras la finalización de la ilustración, si bien es preferible recibir el aviso con antelación para poder realizar los ajustes necesarios en el archivo.
Fecha de entrega. La ejecución de la Obra comenzará una vez que el artista reciba el primer pago (o el pago total), notificando al cliente por correo electrónico el día exacto de inicio. La obra final se entregará antes de la fecha límite acordada Para cumplir con la fecha de entrega final, las revisiones deben aprobarse en un plazo razonable (en 2 día laborable). De no ser así, será necesario negociar una nueva fecha de entrega o se aplicará un cargo adicional por urgencia.No se enviará ningún artículo físico al cliente.II. ProcesoFase de bocetos preliminares (thumbnails): El cliente recibe de 1 a 3 bocetos iniciales en formato JPG de baja resolución y con marca de agua. El cliente tiene la oportunidad de aprobar la composición o seleccionar su opción favorita (si se presentan varios bocetos) y solicitar cambios. En esta fase, el cliente puede solicitar dos (2) rondas de revisiones, tales como modificaciones en la disposición o composición, la forma o el tamaño de los sujetos, su ubicación, etc.Fase de boceto detallado: El cliente recibe 1 boceto detallado en formato JPG de baja resolución y con marca de agua.
El cliente tiene la oportunidad de aprobar la composición o seleccionar su opción favorita (si se presentan varios bocetos) y solicitar cambios. En esta fase, el cliente puede solicitar una (1) ronda de revisiones, como pequeños ajustes en la pose, etc.
Fase de colores planos (flats): Se enviarán al cliente archivos JPG de baja resolución y con marca de agua que incluyan el dibujo lineal y los colores planos para su aprobación; el cliente puede solicitar una (1) ronda de revisiones, como cambios de color o modificaciones de pequeños detalles (expresión, accesorios, etc.).Fase de arte final: Se enviarán al cliente archivos JPG de baja resolución y con marca de agua del arte final para su aprobación. El cliente puede solicitar una (1) ronda de revisiones. Cualquier cambio realizado en esta etapa será menor (principalmente ajustes de color). Una vez recibido el pago completo, el artista entrega al cliente la ilustración terminada.III. Uso personal y comercial de la obra por parte del artista:Tras recibir el pago completo, el Artista otorga al Cliente los siguientes derechos sobre la obra finalizada:— Uso comercial, si se requiere por adelantado [se añade un 100% a la tarifa].
Esto incluye:
Cualquier medio que genere ingresos para el Cliente: Patreon, transmisiones en vivo [streams], mercancía a la venta, etc.
— Uso promocional (marketing y publicidad): incluido en el precio original, sin tarifas adicionales.
Esto incluye:
• Publicar la obra en su sitio web.
• Publicarla en redes sociales, incluidas publicaciones que promocionen sus libros.
• Utilizarla en su boletín informativo y en anuncios de sus libros.
• Imprimirla en marcapáginas y artículos similares para que el Cliente los regale en eventos o junto con pedidos.
También puede utilizarse para cualquier fin promocional no incluido expresamente arriba, siempre que no implique ventas directas distintas a las acordadas previamente para el uso comercial.El Artista se reserva el derecho de utilizar la obra en su portafolio y biografía personal, siempre que dicho uso no se haga público hasta después del lanzamiento inicial de la obra o transcurrido un (1) año desde su creación, en caso de que el Cliente decida no utilizar la obra comercialmente. Bajo este acuerdo, el Artista podrá además permitir que terceros reproduzcan la obra en libros que presenten su trayectoria, siempre que dicha obra no aparezca en la portada ni en anuncios de tales libros. El Artista se compromete a garantizar que cualquier uso de la obra de esta manera vaya acompañado del crédito correspondiente al Cliente como titular de la propiedad intelectual para la cual se creó dicha obra.Este acuerdo no otorga al Cliente el derecho de utilizar la obra del Artista como base para que otro artista la recree, cree obras derivadas o la amplíe de cualquier manera sin el consentimiento expreso por escrito del Artista; esta restricción se aplica a la obra en sí. No se impide al Cliente encargar a otros artistas la creación de representaciones nuevas e independientes de cualquier otro elemento de la propiedad intelectual del Cliente.IV. Propiedad Intelectual: El Cliente es propietario y/o posee los derechos de uso de las imágenes, nombres, obras derivadas y/o trabajos asociados a esta Propiedad Intelectual ("IP") y asume la responsabilidad exclusiva ante cualquier reclamación, demanda, litigio o acusación de difamación si se determinara lo contrario. Es responsabilidad exclusiva del Cliente obtener los derechos, pagar las tasas y/o conseguir los permisos necesarios para utilizar cualquier material suministrado para la creación de la Obra. El Cliente reconoce que la Obra está protegida por sus derechos de autor (IP) y acepta que es su exclusiva responsabilidad proteger dicha IP a su propia costa. Asimismo, el Cliente se compromete a no responsabilizar al Artista de ninguna infracción de IP, ni a exigirle responsabilidades por robo, obras derivadas o fan art que pudieran surgir como consecuencia de la exhibición pública de la Obra.V. Tarifas y Pago:
Los pagos pueden realizarse a través de PayPal (se añadirá una comisión al precio base), Bizum, transferencia bancaria u otro método acordado por ambas partes.
El pago puede efectuarse en su totalidad por adelantado o dividirse en dos plazos: 50% al inicio y 50% a la finalización; la Obra no se entregará hasta que se haya realizado el pago final, y esta modalidad de pago fraccionado conllevará el doble de comisiones de PayPal.Revisiones:
El Artista tendrá la primera oportunidad de realizar las revisiones solicitadas por el Cliente. Si las revisiones no se deben a ningún error por parte del Artista, se cobrará una tarifa adicional. Si el Artista se opone a las revisiones que el Cliente desee realizar, tendrá derecho a que se retire su nombre de la Obra publicada.
Una vez que el Cliente haya gestionado y enviado el pago, el Artista se compromete a entregar la Obra completa.VI. Exención de responsabilidad: El Cliente acepta no responsabilizar al Artista ni a sus representantes por daños derivados de la falta de entrega de la Obra por parte del Artista en el plazo previsto, independientemente de si dicho incumplimiento fue causado por actos u omisiones, intencionados o negligentes, del Artista o de terceros.VII. Copias de cortesía: En caso de que la Obra se utilice en un producto físico publicado inicialmente por el Cliente, este enviará al Artista, a su propia costa, una (1) copia de cortesía de dicho producto, previa solicitud del Artista. Cuando el envío internacional no sea viable o exista un equivalente digital, las partes podrán acordar la entrega de una copia digital en lugar de una física.VIII. Créditos: En la medida en que sea comercialmente razonable y práctico, el Cliente identificará al Artista como el creador de la Obra en los productos y publicaciones que la incorporen o utilicen. La atribución de autoría especificará el nombre del creador como "Lemoncielart" e incluirá un enlace al sitio web del Artista: instagram.com/lemoncielart/IX. Inteligencia Artificial: Al contratar al Artista, el Cliente confirma y garantiza que no se utilizará Inteligencia Artificial (IA) para crear ningún aspecto del producto que incluya la Obra, dado que ello podría perjudicar la reputación del artista. Si se descubriera que el Cliente utilizó IA en cualquier parte de un gráfico o ilustración que contenga dicha Obra, acepta retirar la Obra del Artista del producto sin solicitar ni esperar el reembolso de ninguna parte de los honorarios abonados.Asimismo, el Artista confirma que no se utilizó IA en ninguna fase del proceso de creación o finalización de la obra terminada. También confirma que no se empleó IA como referencia o base, ni para manipular, alterar o finalizar el proyecto.X. Cancelación:El Cliente o el Artista pueden cancelar este acuerdo en cualquier momento notificando por escrito a la otra parte. Si el Cliente o el Artista cancelan un proyecto antes de que se haya realizado algún pago, ninguna de las partes tendrá obligaciones adicionales con la otra y el contrato se considerará cancelado.Si el Artista no completa el trabajo por razones que están bajo su control, deberá reembolsar el importe total al Cliente; sin embargo, si el Cliente decide no continuar con el trabajo una vez iniciado y superada la fase de bocetos preliminares (thumbnails), solo tendrá derecho a un reembolso del 50 %.
